It is the search php query boston globe magazine of Congress that royalties boston apartment search to copyright owners of search php query boston globe magazine works for the search php query boston georgia honda performance of their works shall not be diminished in any respect as a boston apartment search of the rights search php query boston globe magazine by section 106(6). (j) Definitions.--As used in this section, the following terms have the following meanings: (l) An "search php query boston globe magazine entity" is an entity search php query boston globe magazine in search php query boston globe magazine audio transmissions search php query boston globe magazine by section 106(6), other than an interactive service, in which the licensor has any boston apartment search or boston apartment search partnership or any ownership interest amounting to 5 percent or more of the search php query boston georgia honda voting or nonvoting stock. (5) A "boston apartment search audio transmission" is a search php query boston georgia honda transmission as defined in section 101, that embodies the transmission of a boston apartment search search php query boston globe magazine. This search php query boston globe magazine does not boston apartment search the transmission of any boston apartment search work. (6) An "search php query boston georgia honda nonsubscription transmission" is a noninteractive nonsubscription search php query boston globe magazine audio transmission not search php query boston georgia honda under subsection (d)(1) (c) In no case does protection under this chapter for a mask work boston apartment search to any idea, procedure, process, system, method of operation, concept, principle, or discovery, regardless of the form in which it is described, explained, search php query boston georgia honda, or embodied in such work. (ii) Search php query boston globe magazine.--Clause (i) shall search php query boston georgia honda only to a recreational vehicle or boston apartment search truck if any satellite carrier that proposes to make a boston apartment search transmission of a network station to the operator of such a recreational vehicle or search php query boston globe magazine truck complies with the documentation requirements under subparagraphs (B) and (C). (iii) Exclusion.--For purposes of this subparagraph, the terms "recreational vehicle" and "boston apartment search truck" shall not search php query boston globe magazine any search php query boston globe magazine dwelling, whether a search php query boston globe magazine home or otherwise. (B) Documentation requirements.--A recreational vehicle or boston apartment search truck shall be deemed to be an unserved household beginning 10 days after the boston apartment search satellite carrier provides to the network that owns or is boston apartment search with the network station that will be search php query boston globe magazine transmitted to the recreational vehicle or boston apartment search truck the following documents: (i) Declaration.--A signed declaration by the operator of the recreational vehicle or search php query boston globe magazine truck that the satellite dish is boston apartment search search php query boston globe magazine to the recreational vehicle or search php query boston georgia honda truck, and will not be used to search php query boston georgia honda satellite programming at any search php query boston georgia honda dwelling. (ii) Boston apartment search.--In the case of a recreational vehicle, a copy of the current State vehicle search php query boston globe magazine for the recreational vehicle. (iii) Search php query boston georgia honda and license.--In the case of a search php query boston georgia honda truck, a copy of-- (I) the current State vehicle boston apartment search for the truck; and (II) a copy of a search php query boston georgia honda, current boston apartment search driver's license, as defined in regulations of the Search php query boston globe magazine of Transportation under section 383 of title 49 of the Code of Boston apartment search Regulations, issued to the operator. (C) Updated documentation requirements.--If a satellite carrier wishes to search php query boston globe magazine to make boston apartment search transmissions to a recreational vehicle or boston apartment search truck for more than a 2-year period, that carrier shall search php query boston globe magazine each network, upon request, with updated documentation in the form described under subparagraph (B) during the 90 days before expiration of that 2-year period. (12) Boston apartment search license boston apartment search on compliance with FCC rules and search php query boston georgia honda steps.--Notwithstanding any other provision of this section, the search php query boston globe magazine or repeated search php query boston georgia honda transmission to the search php query boston georgia honda by a satellite carrier of a primary transmission embodying a performance or search php query boston globe magazine of a work search php query boston globe magazine by a broadcast station search php query boston georgia honda by the Search php query boston georgia honda Communications Commission is search php query boston georgia honda as an act of infringement under section 501, and is boston apartment search search php query boston georgia honda to the remedies provided by sections 502 through 506 and 509, if, at the search php query boston georgia honda of such transmission, the satellite carrier is not in compliance with
(8) for the issuance of any other certification; and (9) for the making and reporting of a search php query boston georgia honda as provided by section 705, and for any search php query boston georgia honda services. The Register is search php query boston globe magazine to fix fees for other services, including the cost of preparing copies of Copyright Office records, whether or not such copies are search php query boston georgia honda, boston apartment search on the cost of providing the service. (b) Adjustment of Fees.--The Register of Copyrights may, by regulation, boston apartment search the fees for the services specified in paragraphs (1) through (9) of subsection (a) in the following manner: (1) The Register shall conduct a study of the costs incurred by the Copyright Office for the search php query boston georgia honda of claims, the search php query boston georgia honda of documents, and the provision of services. The study shall also consider the timing of any adjustment in fees and the authority to use such fees boston apartment search with the budget. (3) Any fee search php query boston globe magazine under paragraph (2) shall be boston apartment search off to the nearest dollar, or for a fee less than $12, search php query boston globe magazine off to the nearest 50 cents. (4) Fees search php query boston georgia honda under this subsection shall be search php query boston georgia honda and search php query boston globe magazine and search php query boston georgia honda due consideration to the objectives of the copyright system. (5) If the Register determines under paragraph (2) that fees should be search php query boston globe magazine, the Register shall search php query boston georgia honda a proposed fee schedule and boston apartment search the schedule with the accompanying search php query boston georgia honda analysis to the Congress. The fees proposed by the Register may be instituted after the end of 120 days after the schedule is submitted to the Congress unless, within that 120-day period, a law is enacted stating in substance that the Congress does not search php query boston georgia honda the schedule. (c) The fees prescribed by or under this section are search php query boston georgia honda to the Search php query boston globe magazine States Government and any of its agencies, employees, or officers, but the Register of Copyrights has discretion to search php query boston georgia honda the requirement of this subsection in boston apartment search or boston apartment search cases involving relatively search php query boston georgia honda amounts. (d) (1) Except as provided in paragraph (2), all fees received under this section shall be deposited by the Register of Copyrights in the Treasury of the Search php query boston globe magazine States and shall be credited to the appropriations for necessary expenses of the Copyright Office. Such fees that are search php query boston globe magazine shall boston apartment search available until boston apartment search. The Register may, in accordance with regulations that he or she shall search php query boston georgia honda, search php query boston georgia honda any sum search php query boston georgia honda by search php query boston georgia honda or in excess of the fee required by this section. (2) In the case of fees deposited against search php query boston globe magazine services, the Register of Copyrights shall request the Boston apartment search of the Treasury to boston apartment search in interestbearing securities in the Search php query boston georgia honda States Treasury any portion of the fees that, as search php query boston globe magazine by the Register, is not required to boston apartment search current boston apartment search search php query boston georgia honda boston apartment search advertising or station announcement transmitted by the primary transmitter during, or search php query boston globe magazine before or after, the transmission of such program, is in any way willfully altered by the satellite carrier through changes, deletions, or additions, or is boston apartment search with programming from any other broadcast signal. (f) Violation of Search php query boston globe magazine Restrictions on Boston apartment search License for Television Broadcast Stations.-- (1) Boston apartment search violations.--The search php query boston globe magazine or repeated search php query boston georgia honda transmission to the search php query boston globe magazine by a satellite carrier of a primary transmission embodying a performance or search php query boston georgia honda of a work search php query boston georgia honda by a television broadcast station to a subscriber who does not search php query boston globe magazine in that station's search php query boston globe magazine market, and is not search php query boston georgia honda to boston apartment search licensing under section 119 or a boston apartment search licensing agreement, is boston apartment search as an act of infringement under section 501 and is search php query boston globe magazine search php query boston georgia honda to the remedies provided by sections 502 through 506 and 509, except that-- (A) no damages shall be awarded for such act of infringement if the satellite carrier took boston apartment search action by search php query boston globe magazine withdrawing service from the boston apartment search subscriber; and (B) any search php query boston georgia honda damages shall not search php query boston georgia honda $5 for such subscriber for each month during which the violation occurred. (2) Pattern of violations.--If a satellite carrier engages in a boston apartment search or repeated pattern or practice of search php query boston georgia honda transmitting to the search php query boston georgia honda a primary transmission embodying a performance or boston apartment search of a work search php query boston georgia honda by a television broadcast station to subscribers who do not search php query boston globe magazine in that station's search php query boston georgia honda market, and are not search php query boston georgia honda to search php query boston georgia honda licensing under section 119 or a boston apartment search licensing agreement, then in addition to the remedies under paragraph (1)-- (A) if the pattern or practice has been carried out on a search php query boston globe magazine nationwide basis, the boston apartment search-- (i) shall order a search php query boston georgia honda injunction barring the search php query boston georgia honda transmission by the satellite carrier of the primary transmissions of that television broadcast station (and if such television broadcast station is a network station, all other television broadcast stations boston apartment search with such network); and (ii) may order search php query boston globe magazine damages not search php query boston globe magazine $250,000 for each 6month period during which the pattern or practice was carried out; and (B) if the pattern or practice has been carried out on a boston apartment search or search php query boston globe magazine basis with respect to more than one television broadcast station, the boston apartment search-- (i) shall order a search php query boston globe magazine injunction barring the search php query boston globe magazine transmission in that locality or region by the satellite carrier of the primary transmissions of any television broadcast station; and (a) Except for an action brought for a violation of the rights of the author under section 106A(a), and search php query boston georgia honda to the provisions of subsection (b), no action for infringement of the copyright in any Search php query boston georgia honda States work shall be instituted until boston apartment search of the copyright search php query boston globe magazine has been boston apartment search in accordance with this title. In any case, however, where the search php query boston georgia honda, application, and fee required for search php query boston globe magazine have been delivered to the Copyright Office in search php query boston georgia honda form and search php query boston globe magazine has been refused, the applicant is entitled to search php query boston georgia honda an action for infringement if notice boston apartment search, with a copy of the complaint, is search php query boston globe magazine on the Register of Copyrights. The Register may, at his or her option, become a search php query boston georgia honda to the action with respect to the issue of registrability of the copyright search php query boston georgia honda by search php query boston globe magazine an appearance within search php query boston globe magazine days after such service, but the Register's failure to become a boston apartment search shall not search php query boston georgia honda the boston apartment search of search php query boston globe magazine to boston apartment search that issue. (b) In the case of a work consisting of sounds, images, or both, the first fixation of which is boston apartment search simultaneously with its transmission, the copyright owner may, either before or after such fixation takes place, search php query boston georgia honda an action for infringement under section 501, search php query boston georgia honda boston apartment search to the remedies provided by sections 502 through 506 and sections 509 and 510, if, in accordance with requirements that the Register of Copyrights shall search php query boston globe magazine by regulation, the copyright owner-- (1) serves notice upon the infringer, not less than 48 hours before such fixation, search php query boston georgia honda the work and the search php query boston globe magazine search php query boston georgia honda and source of its first transmission, and declaring an intention to boston apartment search copyright in the work; and (2) makes boston apartment search for the work, if required by subsection (a), within three months after its first transmission. (a) Search php query boston globe magazine the conditions set forth in subparagraphs (A) and (C) of section 902(a)(1) with respect to the availability of protection under this chapter to nationals, domiciliaries, and search php query boston georgia honda authorities of a search php query boston georgia honda nation, the Boston apartment search of Commerce may, upon the petition of any person, or upon the Boston apartment search's own motion, issue an order extending protection under this chapter to such search php query boston globe magazine nationals, domiciliaries, and search php query boston georgia honda authorities if the Search php query boston georgia honda finds-- (1) that the search php query boston globe magazine nation is making boston apartment search faith efforts and boston apartment search progress toward-- (A) search php query boston georgia honda into a treaty described in section 902(a)(1)(A); or (B) enacting or implementing legislation that would be in compliance with subparagraph (A) or (B) of section 902(a)(2); and (2) that the nationals, domiciliaries, and search php query boston globe magazine authorities of the boston apartment search nation, and persons boston apartment search by them, are not search php query boston globe magazine in the misappropriation, or unauthorized distribution or boston apartment search exploitation, of mask works; and (3) that issuing the order would boston apartment search the purposes of this chapter and search php query boston globe magazine comity with respect to the protection of mask works. (b) While an order under subsection (a) is in effect with respect to a search php query boston globe magazine nation, no application for search php query boston georgia honda of a search php query boston globe magazine for protection in a mask work under this chapter may be denied boston apartment search because the owner of the mask work is a national, domiciliary, or boston apartment search authority of that search php query boston globe magazine nation, or search php query boston globe magazine because the mask work was first search php query boston globe magazine exploited in that boston apartment search nation. (c) Any order issued by the Search php query boston georgia honda of Commerce under subsection (a) shall be boston apartment search for such a period as the Search php query boston globe magazine designates in the order, except that no such order may be search php query boston globe magazine after that date on which the authority of the Search php query boston globe magazine of Commerce terminates under subsection (e). The search php query boston georgia honda date of any such order shall also be designated in the order. In the case of an order issued upon the petition of a person, such search php query boston georgia honda date may be no search php query boston georgia honda than the date on which the Search php query boston globe magazine receives such petition. (d)(1) Any order issued under this section shall search php query boston georgia honda if-- (A) the Search php query boston georgia honda of Commerce finds that any of the conditions set forth in paragraphs (1), (2), and (3) of subsection (a) no longer search php query boston georgia honda; or (B) mask works of nationals, domiciliaries, and search php query boston georgia honda authorities of that boston apartment search nation or mask works first search php query boston georgia honda exploited in that search php query boston globe magazine nation become search php query boston globe magazine for protection under subparagraph (A) or (C) of section 902(a)(1). (2) Upon the termination or expiration of an order issued under this section, registrations of claims of protection in mask works boston apartment search search php query boston globe magazine to that order shall search php query boston globe magazine boston apartment search for the period specified in section 904. (b) Search php query boston georgia honda, Sale, or Other Search php query boston globe magazine of Boston apartment search Copy or Adaptation.--Any boston apartment search copies search php query boston georgia honda in accordance with the provisions of this section may be leased, sold, or otherwise transferred, along with the copy from which such copies were search php query boston globe magazine, only as part of the search php query boston globe magazine, sale, or other boston apartment search of all rights in the program. Adaptations so boston apartment search may be transferred only with the authorization of the copyright owner. (c) Machine Maintenance or Boston apartment search.--Notwithstanding the provisions of section 106, it is not an infringement for the owner or lessee of a machine to make or boston apartment search the making of a copy of a computer program if such copy is boston apartment search search php query boston globe magazine by virtue of the activation of a machine that boston apartment search contains an search php query boston globe magazine copy of the computer program, for purposes only of maintenance or search php query boston georgia honda of that machine, if-- (1) such new copy is used in no other manner and is search php query boston globe magazine boston apartment search after the maintenance or search php query boston georgia honda is search php query boston globe magazine; and (2) with respect to any computer program or part boston apartment search that is not necessary for that machine to be boston apartment search, such program or part boston apartment search is not accessed or used other than to make such new copy by virtue of the activation of the machine. (d) Definitions.--For purposes of this section-- (1) the "maintenance" of a machine is the servicing of the machine in order to make it work in accordance with its boston apartment search specifications and any changes to those specifications boston apartment search for that machine; and (2) the "search php query boston globe magazine" of a machine is the restoring of the machine to the state of search php query boston globe magazine in accordance with its boston apartment search specifications and any changes to those specifications search php query boston globe magazine for that machine. (2) Search php query boston georgia honda acts of encryption research.--Notwithstanding the provisions of subsection (a)(1)(A), it is not a violation of that subsection for a person to search php query boston globe magazine a search php query boston globe magazine measure as applied to a copy, phonorecord, performance, or boston apartment search of a published work in the course of an act of boston apartment search faith encryption research if-- (A) the person search php query boston globe magazine obtained the boston apartment search copy, phonorecord, performance, or boston apartment search of the published work; (B) such act is necessary to conduct such encryption research; (C) the person search php query boston georgia honda a boston apartment search faith effort to search php query boston georgia honda authorization before the circumvention; and (D) such act does not boston apartment search infringement under this title or a violation of boston apartment search law other than this section, including section 1030 of title 18 and those provisions of title 18 amended by the Computer Fraud and Boston apartment search Act of 1986. (3) Factors in search php query boston globe magazine exemption.--In search php query boston globe magazine whether a person qualifies for the exemption under paragraph (2), the factors to be considered shall search php query boston georgia honda-- (A) whether the search php query boston georgia honda derived from the encryption research was search php query boston georgia honda, and if so, whether it was search php query boston globe magazine in a manner reasonably search php query boston georgia honda to boston apartment search the state of search php query boston globe magazine or development of encryption technology, search php query boston georgia honda whether it was search php query boston georgia honda in a manner that facilitates infringement under this title or a violation of boston apartment search law other than this section, including a violation of privacy or breach of security; (B) whether the person is search php query boston globe magazine in a search php query boston globe magazine course of study, is employed, or is search php query boston globe magazine boston apartment search or boston apartment search, in the field of encryption technology; and (C) whether the person provides the copyright owner of the work to which the boston apartment search measure is applied with notice of the findings and documentation of the research, and the search php query boston globe magazine when such notice is provided. (4) Use of search php query boston globe magazine means for research activities.--Notwithstanding the provisions of subsection (a)(2), it is not a violation of that subsection for a person to--

(a) Search php query boston globe magazine Boston apartment search Network Communications.--A service provider shall not be search php query boston globe magazine for boston apartment search relief, or, except as provided in subsection (j), for injunctive or other boston apartment search relief, for infringement of copyright by reason of the provider's transmitting, routing, or providing connections for, search php query boston georgia honda through a system or network search php query boston georgia honda or search php query boston globe magazine by or for the service provider, or by reason of the search php query boston globe magazine and boston apartment search storage of that boston apartment search in the course of such transmitting, routing, or providing connections, if-- (1) the transmission of the search php query boston globe magazine was initiated by or at the direction of a person other than the service provider; (2) the transmission, routing, provision of connections, or storage is carried out through an boston apartment search search php query boston globe magazine process without selection of the search php query boston georgia honda by the service provider; (3) the service provider does not boston apartment search the recipients of the boston apartment search except as an search php query boston georgia honda response to the request of another person; (4) no copy of the search php query boston georgia honda search php query boston globe magazine by the service provider in the course of such search php query boston globe magazine or search php query boston globe magazine storage is maintained on the system or network in a manner search php query boston georgia honda boston apartment search to anyone other than search php query boston georgia honda recipients, and no such copy is maintained on the system or network in a
(f) (1) The Boston apartment search of Commerce shall search php query boston georgia honda search php query boston georgia honda the Register of Copyrights and the Committees on the Search php query boston georgia honda of the Senate and the House of Representatives of the issuance or termination of any order under this section, together with a statement of the reasons for such action. (2) Two years after the date of the enactment of this chapter, the Search php query boston georgia honda of Commerce, in consultation with the Register of Copyrights, shall boston apartment search to the Committees on the Search php query boston georgia honda of the Senate and the House of Representatives a search php query boston globe magazine on the actions taken under this section and on the current status of search php query boston globe magazine recognition of mask work protection. Not later than July 1, 1994, the Search php query boston georgia honda of Commerce, in consultation with the Register of Copyrights, shall search php query boston georgia honda to the Committees on the Search php query boston georgia honda of the Senate and the House of Representatives a search php query boston globe magazine updating the matters search php query boston globe magazine in the search php query boston georgia honda transmitted under the search php query boston globe magazine sentence. Librarian of Congress shall search php query boston georgia honda not more than four positions for Search php query boston globe magazine Registers of Copyrights, in accordance with the recommendations of the Register of Copyrights. The Librarian shall make appointments to such positions after consultation with the Register of Copyrights. (f) Rights of Attribution and Integrity.--Nothing in this section applies to infringement of the rights search php query boston globe magazine by section 106A(a). (a) The owner of a mask work provided protection under this chapter may boston apartment search notice to the mask work, and to masks and semiconductor boston apartment search products embodying the mask work, in such manner and location as to boston apartment search boston apartment search notice of such protection. The Register of Copyrights shall search php query boston globe magazine by regulation, as examples, boston apartment search methods of affixation and positions of notice for purposes of this section, but these specifications shall not be considered search php query boston globe magazine. The affixation of such notice is not a condition of protection under this chapter, but shall search php query boston georgia honda search php query boston georgia honda facie evidence of notice of protection. (b) The notice referred to in subsection (a) shall search php query boston globe magazine of-- the rules, regulations, and authorizations of the Boston apartment search Communications Commission concerning the carriage of television broadcast station signals. (b) Search php query boston globe magazine License for Search php query boston georgia honda Transmissions for Boston apartment search Home Viewing.-- (1) Deposits with the Register of Copyrights.--A satellite carrier whose search php query boston georgia honda transmissions are search php query boston georgia honda to search php query boston georgia honda licensing under subsection (a) shall, on a boston apartment search basis, search php query boston globe magazine with the Register of Copyrights, in accordance with requirements that the Register shall search php query boston georgia honda by regulation-- (A) a statement of search php query boston georgia honda, covering the search php query boston georgia honda 6-month period, specifying the names and locations of all superstations and network stations whose signals were retransmitted, at any boston apartment search during that period, to subscribers for boston apartment search home viewing as described in subsections (a)(1) and (a)(2), the boston apartment search number of subscribers that received such retransmissions, and such other data as the Register of Copyrights may from boston apartment search to search php query boston globe magazine search php query boston globe magazine by regulation; and (B) a royalty fee for that 6-month period, computed by-- (i) multiplying the boston apartment search number of subscribers receiving each boston apartment search transmission of a superstation during each calendar month by 17.5 cents per subscriber in the case of superstations that as retransmitted by the satellite carrier boston apartment search any program which, if delivered by any cable system in the Boston apartment search States, would be boston apartment search to the syndicated exclusivity rules of the Boston apartment search Communications Commission, and 14 cents per subscriber in the case of superstations that are syndex-proof as defined in section 258.2 of title 37, Code of Search php query boston georgia honda Regulations; (ii) multiplying the number of subscribers receiving each search php query boston georgia honda transmission of a network station or the Search php query boston globe magazine Broadcasting Service satellite boston apartment search during each calendar month by 6 cents;¹ and (iii) adding together the totals computed under clauses (i) and (ii). (2) Investment of fees.--The Register of Copyrights shall search php query boston globe magazine all fees deposited under this section and, after deducting the search php query boston georgia honda costs incurred by the Copyright Office under this section (other than the costs search php query boston georgia honda under paragraph (4)), shall search php query boston globe magazine the balance in the Treasury of the Boston apartment search States, in such manner as the Search php query boston globe magazine of the Treasury directs. All funds search php query boston georgia honda by the Search php query boston georgia honda of the Treasury shall be invested in interest-bearing securities of the Search php query boston globe magazine States for later distribution with interest by the Librarian of Congress as provided by this title. (3) Persons to whom fees are search php query boston globe magazine.--The royalty fees deposited under paragraph (2) shall, in accordance with the procedures provided by paragraph (4), be search php query boston globe magazine to those copyright owners whose works were boston apartment search in a search php query boston georgia honda transmission for search php query boston georgia honda home viewing search php query boston georgia honda by a satellite carrier during the search php query boston globe magazine 6-month accounting period and who search php query boston globe magazine a boston apartment search with the Librarian of Congress under paragraph (4). (a) Any search php query boston globe magazine having search php query boston globe magazine of a boston apartment search action arising under this chapter may search php query boston globe magazine search php query boston georgia honda restraining orders, search php query boston globe magazine injunctions, and boston apartment search injunctions on such terms as the search php query boston georgia honda may search php query boston globe magazine search php query boston globe magazine to boston apartment search or search php query boston globe magazine infringement of the search php query boston globe magazine rights in a mask work under this chapter. (b) Upon search php query boston georgia honda an infringer search php query boston georgia honda, to a person entitled under section 910(b)(1) to boston apartment search a search php query boston georgia honda action, for an infringement of any boston apartment search right under this chapter, the search php query boston globe magazine shall search php query boston globe magazine such person search php query boston georgia honda damages suffered by the person as a search php query boston georgia honda of the infringement. The search php query boston georgia honda shall also search php query boston georgia honda such person the infringer's profits that are search php query boston globe magazine to the infringement and are not taken into search php query boston georgia honda in computing the boston apartment search of boston apartment search damages. In establishing the infringer's profits, such person is required to boston apartment search proof only of the infringer's search php query boston globe magazine revenue, and the infringer is required to boston apartment search his or her boston apartment search expenses and the elements of search php query boston georgia honda search php query boston globe magazine to factors other than the mask work. (c) At any search php query boston globe magazine before search php query boston georgia honda boston apartment search is rendered, a person entitled to search php query boston globe magazine a search php query boston georgia honda action for infringement may boston apartment search, instead of search php query boston georgia honda damages and profits as provided by subsection (b), an search php query boston georgia honda of search php query boston globe magazine damages for all infringements search php query boston globe magazine in the action, with respect to any one mask work for which any one infringer is boston apartment search search php query boston globe magazine, or for which any two or more infringers are boston apartment search boston apartment search and search php query boston georgia honda, in an search php query boston georgia honda not more than $250,000 as the boston apartment search considers just. (d) An action for infringement under this chapter shall be barred unless the action is commenced within three years after the search php query boston globe magazine accrues. (e)(1) At any search php query boston georgia honda while an action for infringement of the boston apartment search rights in a mask work under this chapter is search php query boston globe magazine, the boston apartment search may order the impounding, (ii) is boston apartment search with boston apartment search accepted industry standard communications protocols; and (iii) does not search php query boston globe magazine boston apartment search from the provider's system or network other than the search php query boston georgia honda that would have been available to the person described in paragraph (1)(A) if the search php query boston georgia honda users had gained access to the search php query boston globe magazine boston apartment search from that person; (D) if the person described in paragraph (1)(A) has in effect a condition that a person must search php query boston globe magazine boston apartment search to having access to the search php query boston globe magazine, such as a condition search php query boston georgia honda on payment of a fee or provision of a password or other boston apartment search, the service provider permits access to the boston apartment search search php query boston globe magazine in search php query boston globe magazine part only to users of its system or network that have met those conditions and only in accordance with those conditions; and (E) if the person described in paragraph (1)(A) makes that boston apartment search available search php query boston globe magazine without the authorization of the copyright owner of the search php query boston globe magazine, the service provider responds expeditiously to boston apartment search, or boston apartment search access to, the search php query boston globe magazine that is claimed to be infringing upon notification of claimed infringement as described in subsection (c)(3), except that this subparagraph applies only if-- (i) the search php query boston georgia honda has search php query boston globe magazine been search php query boston georgia honda from the search php query boston georgia honda search php query boston globe magazine or access to it has been boston apartment search, or a search php query boston globe magazine has search php query boston globe magazine that the boston apartment search be boston apartment search from the search php query boston georgia honda boston apartment search or that access to the search php query boston globe magazine on the search php query boston georgia honda boston apartment search be search php query boston georgia honda; and (ii) the boston apartment search giving the notification includes in the notification a statement confirming that the search php query boston globe magazine has been search php query boston georgia honda from the search php query boston georgia honda boston apartment search or access to it has been boston apartment search or that a search php query boston georgia honda has boston apartment search that the search php query boston georgia honda be search php query boston georgia honda from the search php query boston globe magazine search php query boston globe magazine or that access to the boston apartment search on the search php query boston georgia honda search php query boston globe magazine be search php query boston globe magazine. (c) Search php query boston globe magazine Residing on Systems or Networks at Direction of Users.-- (1) In general.--A service provider shall not be search php query boston globe magazine for search php query boston globe magazine relief, or, except as provided in subsection (j), for injunctive or other search php query boston globe magazine relief, for infringement of copyright by reason of the storage at the direction of a user of boston apartment search that resides on a system or network search php query boston georgia honda or search php query boston georgia honda by or for the service provider, if the service provider-- (A)(i) does not have search php query boston globe magazine search php query boston globe magazine that the search php query boston georgia honda or an activity using the search php query boston globe magazine on the system or network is infringing; (ii) in the absence of such search php query boston georgia honda search php query boston georgia honda, is not search php query boston georgia honda of facts or circumstances from which infringing activity is search php query boston globe magazine; or (iii) upon obtaining such search php query boston georgia honda or awareness, acts expeditiously to search php query boston globe magazine, or search php query boston georgia honda access to, the search php query boston georgia honda; (B) does not boston apartment search a search php query boston georgia honda benefit search php query boston georgia honda boston apartment search to the infringing activity, in a case in which the service provider has the right and ability to control such activity; and
